19) The Government reserve the right to construct, in such a manner
and at such a time as the said Director shall think fit, a promenade along the whole beach. The cost of construction of that portion along the South West boundary of Lot C shall be borne by the Lessee. (20) The Lessee of the new Lots shall pay the cost of removing any
Chinese graves at present on the areas, if such removal becomes necessary; the work to be done by the Tung Wah Hospital Authorities. (21) The Lessee must notify the Superintendent of Botanical and Forestry
Department in the event of requiring the removal of any trees from
Such the new lots, which may interfere with building operations. trees will be removed by the said Superintendent.
(22) The Lessee shall pay into the Colonial Treasury, on demand, the cost of diverting or removing any cable, telegraph or telephone line, sewer or culvert, which the Director of Public Works may consider it necessary to have removed or diverted.
(23) The Lessee shall pay into the Colonial Treasury on demand the sum
of $2,000 towards the cost of removing and relaying the existing Government water main traversing the said lots.
(24) The Lessee shall have the right of free and uninterrupted access
to the sea covering the area running immediately parallel with the frontage of Lot "C" for the purpose of the use of that Lot as a public bathing pavilion and pleasure resort, but save as aforesaid shall not have any right whatsoever over the foreshore and seabed in front of the said Lot.
(25) After the formation of the road mentioned in Special Condition No.17 the Lessee shall be allowed to use the Beach Road to the North West boundary of the Lot as long as it remains open to the public. Such use does not extend to motor buses.
(26) In so far as the Particulars and General and Special Conditions
of Sale relate to Lot A, (coloured blue) the same shall be subject to the sanction of the Secretary of State for the sale of the Lot by private treaty and if such sanction shall be refused the Lessee shall be at liberty to reconsider the whole scheme.
